These terms are the agreement between you and When. You own what you put in When. After a 14-day free trial, the Founder Plan costs $160 a year, with a 30-day money-back guarantee. You can export your data or leave at any time, and we'll tell you before anything important changes.

The agreement

These terms are an agreement between you and Aaron Pepper, who runs When from Ontario, Canada ("When", "we", "us"). They cover when.day, the When app, and its API. By creating an account or using When, you agree to them, and our Privacy Policy explains how we handle your data.

Who can use When

You must be 18 or older. Use an email address you control, keep your details accurate, and use one account per person. Don't create an account if we've closed one of yours for breaking these terms.

New accounts join a waitlist. We give access by invite code or as we open more spots, and we decide who gets access.

Your account

Keep your sign-in secure, and tell us at hey@when.day if you think someone else has used your account. You're responsible for what happens in it. Settings lists your signed-in devices and can sign out all the others.

Your content

You own the calendars, events, notes, and everything else you put in When. You give us permission to store, copy, process, and display that content only as needed to run When for you. That includes sending it to the providers in the Privacy Policy and showing what you share or publish to the people you choose.

Only add what you have the right to add, including other people's details on events, invitations, and bookings.

If you send us feedback or ideas, we can use them without owing you anything.

Acceptable use

Don't:

  • get around rate limits, access controls, or plan limits, or test our security outside the rules on our Security page;
  • overload or disrupt When;
  • collect other people's data from parts of When that aren't public;
  • use invitations, booking pages, or public pages to spam, harass, impersonate, or mislead anyone;
  • upload malware, or content that's illegal or infringes someone's rights;
  • resell When or share your account with others.

Crawlers and AI agents are welcome on public pages.

The AI assistant

AI features are on for new accounts, and you can turn them off during setup or in Settings. The assistant can misread a request or get your calendar wrong, so check what it does. It creates or edits a single item right away. Creating several items, changing a repeating series, or archiving anything waits for your approval, and Undo reverses recent changes.

If you connect another AI app to When, it acts on your calendars with the access you approve, and you're responsible for what it does.

Sharing, public pages, and bookings

When you share a calendar, make it public, or turn on a booking page, the people you share with and the people who visit see what you choose to show. You're responsible for what you publish and for how you contact the people who book time with you. People you share with and guests who book with you don't pay.

We can change or remove a username that impersonates someone or infringes someone else's rights.

Connected services

Connecting Google Calendar, Outlook Calendar, or another AI app also puts you under that service's terms. We aren't responsible for those services, and imports depend on them working.

Plans and billing

  • When has one plan, the Founder Plan, at US$160 a year. It is billed yearly; there is no monthly or free plan.
  • Each account gets a 14-day free trial, starting the day it gets access, with no card needed. If you subscribe during the trial, you're charged when it ends.
  • Your plan renews each year until you cancel. We email you the date and amount 30 days before each renewal.
  • Cancel at any time with Manage billing in Settings, or by emailing hey@when.day if you can't reach it, such as after a failed payment. Your plan stays active until the end of the year you've paid for.
  • Changed your mind? Email hey@when.day within 30 days of a payment and we'll refund it in full.
  • Polar sells the subscription as the merchant of record. It takes payment, adds any sales tax or VAT, and sends your receipts, and its terms also apply to the purchase.

When a trial or plan ends

If your trial ends or a payment doesn't go through, your account becomes read-only. You can still sign in, see everything, and export it, but you can't create or edit items, and connected calendars stop syncing. Calendars you've shared stay visible but stop updating, and booking pages turn off. Subscribing again restores everything.

Ending your account

You can delete your account at any time in Settings. The Privacy Policy explains what happens to your data.

We can suspend or close an account that breaks these terms, puts other people at risk, or that the law requires us to close. Unless the problem is serious or urgent, we'll tell you first and give you a chance to fix it and export your data. If we close your account without a breach on your part, or shut When down, we'll refund the unused part of your plan and give you at least 30 days to export your data.

Changes to When

When is new and changes often. We add, change, and sometimes remove features. If a change takes away something important you pay for, we'll tell you ahead of time.

Disclaimers

We provide When as is and as available. To the extent the law allows, we make no promises beyond these terms, including that When will be uninterrupted, free of errors, or fit for a particular purpose. If losing your data would harm you, export a copy now and then.

Limits on liability

To the extent the law allows, When isn't liable for indirect or consequential losses, such as lost profits, lost data, or a missed appointment. Our total liability for any claim about When is limited to the greater of what you paid us in the 12 months before the claim or US$100.

Nothing in these terms limits rights you have under consumer protection laws that can't be waived, or liability the law doesn't allow us to limit, such as for fraud.

Changes to these terms

For an important change, we'll email you at least 30 days before it takes effect. If you don't agree, you can cancel and we'll refund the unused part of your plan; using When after the change takes effect means you accept it. Smaller edits, such as clearer wording, take effect when we post them. The date at the top shows the last change.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless the law where you live lets you bring them in your local courts. There is no arbitration clause or class action waiver.

General

These terms and the Privacy Policy are the whole agreement between you and When. If part of them can't be enforced, the rest still applies, and not enforcing a term isn't giving it up. We can transfer this agreement to a company that takes over When, including one we form to run it, and we'll tell you if we do. You can't transfer it without our permission.
